Can I get an interim payment with a work injury claim?

If you have been injured at work and are facing urgent financial pressures, it may be possible to request an interim payment. This is an advance on your final compensation award, designed to help cover immediate costs while your claim is ongoing.
What is an interim payment?
An interim payment is a partial compensation payment made before your claim is fully settled. It is deducted from your eventual compensation award. Interim payments are most often granted in serious or complex cases where claims can take many months or even years to resolve.
Civil Procedure Rules allow interim payments where liability is admitted and compensation will be payable (Source: Civil Procedure Rules, Part 25)
Why interim payments matter
Insurers sometimes use delaying tactics to pressure injured workers into accepting early, lower-value offers (often called low-ball offers or pre-medical offers). Interim payments reduce this pressure by giving you access to money you need now, so you do not have to settle for less than your claim is worth.

What counts as an immediate need?
Interim payments are intended to cover urgent expenses, such as:
- Private medical treatment or rehabilitation
- Care and support costs
- Adaptations to your home or vehicle
- Specialist equipment to aid recovery
- Living expenses such as rent, mortgage payments, or household bills
How quickly can I receive an interim payment?
If your employer admits liability, interim payments can often be arranged quickly through negotiation between your solicitor and the insurer. If liability is denied, your solicitor may need to issue formal proceedings and apply to the court. Courts usually process interim payment applications without delay if the evidence is strong.
What evidence does a solicitor need?
Your solicitor will need to show the court that:
- You are likely to win your claim
- You have a specific, immediate need for financial support
- The amount requested is reasonable in the context of your likely final award
- Details of your past and projected financial losses (special damages) have been provided
Can I receive more than one interim payment?
Yes. You can apply for multiple interim payments if necessary. Each application must meet the same legal criteria and demonstrate that your need continues to exist.
